DOCSECRETS TERMS AND CONDITIONS OF USE

Jnovate AB ("Jnovate"), provides a Google Docs add-on that lets users keep encrypted secrets in their Google Docs documents (the "Service", “add-on”). The Service is made available via Google Add-ons store or Google Apps marketplace as a Google Docs add-on (the “Add-on”).
By using the Service, you agree to these Terms and Conditions of Use and our processing of your personal data in accordance with our Privacy Policy (jointly referred to as the "Agreement") located on our “Site” (www.docsecrets.net) here. In order to use the Service you must agree to this Agreement. This Agreement applies notwithstanding if you have access to the Service free of charge or if you pay for a subscription.
In order to conclude a binding contract with Jnovate and use the Service you need to: (i) be at least 18 years old or older; or (ii) have your parent or guardian's consent to terms of this Agreement. Please read through the entire Agreement carefully. By installing or using the Add-on you acknowledge and agree to the terms of the Agreement for the provision of the Service. The Agreement is concluded in English.
If you do not accept the terms of this Agreement, or do not meet the above mentioned requirements, you cannot use the Service.
Your use of the Service
General
You may use the Service to, among other things, view and insert secrets into your Google Docs documents. Once you install the Add-on onto your Google account you accept this Agreement and you may use the Services.
Passphrase
The Add-on encrypts your secrets using a passphrase that you provide. Only you know your passphrase and you are responsible for keeping your passphrases secret and safe. You hereby acknowledge that if you forget your passphrase for a document your secrets will be locked in.
Google permissions
In order to use the Service, you need to grant the Add-on sufficient permissions or you can't use the Service.
Revision history tool
When you are censoring text in Google Docs using the Add-on Google saves a version containing the original text in revision history. The Add-on makes available a tool (the “Tool”) that creates a copy/backup of the original document. The copied document will only have one revision. The Tool requires that you grant the Tool additional permissions. The Tool is provided “as is” and you should verify that the copied document can be opened, that your passphrase works and that your secrets have been imported before you manually delete the original document.
Quotas for Google services
Google services impose daily quotas and hard limitations on some features of the Add-on. Daily quotas are refreshed at the end of a 24-hour window; the exact time of this refresh, however, varies between users. If a quota is exceeded Google will throw an exception and terminate execution of the Add-on. Google quotas impose a limit on the number of and the length of your secrets. You hereby acknowledge that the Add-on is intended for single words or short sentences not entire pages or documents.
Suspension from the Service
We have the right to suspend your access to the Service for your breach of this Agreement, or any applicable law or regulation. Suspension of your access to the Service may be affected without prior notice.

If you have any questions or suggestions regarding the Service, please contact our customer support. Contact information to the customer support is available on https://www.docsecrets.net/support. Complaints of any kind are handled by the customer service.
Electronic communications
Your registration to use the Add-on and/or the Service provided on or through the Add-on, you consent to receiving electronic communications from Jnovate. These electronic communications may include notices about applicable fees and charges, transactional information and other information concerning or related to the Add-on and/or services provided on or through the the Service. These electronic communications are part of your relationship with Jnovate. You agree that any notices, agreements, disclosures or other communications that we send you electronically will satisfy any legal communication requirements, including that such communications be in writing.
For users located outside of the European Economic Area (EEA):
Your registration to use the Service constitutes your consent to receive email communications from Jnovate, including messages regarding customer service issues and other matters. You may opt not to receive email correspondence, other than technical notifications and email regarding issues related to your account and your use of the Site and Services, at any time by following the link included in the email messages.
For users located in the European Economic Area (EEA):
We only send marketing communications to users located in the European Economic Area (EEA) with your prior consent, and you may withdraw your consent at any time by clicking the “unsubscribe” link found within Jnovate emails and changing your contact preferences. Please note you will continue to receive transactional messages related to our Services, even if you unsubscribe from marketing emails.
Intellectual property
The content of the Service, such as labels, graphics, logos, button icons, images, as well as the arrangement and compilations of these, all software used in the Service are the sole property of Jnovate. You agree to comply with all such applicable laws and agreements, and not to alter, obscure or remove the notices regarding copyright or ownership rights in such content.
All rights not expressly granted herein are reserved.
The software which is included in the Service and the Add-on is licensed, and not sold, to you. By signing up for the Service you are given a personal, non-exclusive, non-transferable right, which is limited in time, to use the software. We retain ownership of all copies of the software, even after the software has been installed on your computer, smartphone, tablet, or mobile device. We have the right to assign this license or any part thereof to any third party without restrictions. You may not assign this license or any part thereof or transfer or sublicense your rights under the license to any third party.
Any third party software included in the Service is licensed to you either under contract or in accordance with the respective third-party license for such software. The terms of use for such third party software are published on the Add-on.
Processing of Personal Data
Your registration to use the Service constitutes your consent to our processing of your personal data in accordance with our Privacy Policy (https://www.docsecrets.net/privacy-policy).
Force Majeure
Either party is relieved from any and all liabilities by reason of any circumstances beyond its immediate control, which impedes, delays or aggravates any obligations to be fulfilled by it under this Agreement, such as changes in laws and regulations or in the interpretation thereof, acts of authorities, war, acts of war, labour disputes, strikes, major accidents and currency restrictions. The reservation in respect of labour disputes or strikes is applicable even if the party claiming relief initiates or is the object of such action itself.
Feedback
If you send or transmit any communications, comments, questions, suggestions, or related materials to Jnovate, whether by letter, e-mail, telephone, or otherwise (collectively, "Feedback"), suggesting or recommending changes to the Service, including, without limitation, new features or functionality relating thereto, all such Feedback is, and will be treated as, non-confidential and non-proprietary. You hereby assign all right, title, and interest in, and Jnovate is free to use, without any attribution or compensation to you, any ideas, know-how, concepts, techniques, or other intellectual property and proprietary rights contained in the Feedback, whether or not patentable, for any purpose whatsoever, including but not limited to, developing, manufacturing, having manufactured, licensing, marketing, and selling, directly or indirectly, products and services using such Feedback. You understand and agree that Jnovate is not obligated to use, display, reproduce, or distribute any such ideas, know-how, concepts, or techniques contained in the Feedback, and you have no right to compel such use, display, reproduction, or distribution.
No warranty
Jnovate endeavors to provide the best service we can, however, you agree that THE SERVICE ARE PROVIDED TO YOU ON AN "AS IS" "AS AVAILABLE" AND "WHERE-IS" BASIS WITH NO WARRANTY OF IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS. Jnovate DOES NOT PROVIDE ANY WARRANTIES AGAINST VIRUSES, SPYWARE OR MALWARE THAT MAY BE INSTALLED ON YOUR COMPUTER, TABLET, SMARTPHONE OR MOBILE DEVICE. NEITHER WE, OUR LICENSORS NOR THE SUPPLIERS CAN GUARANTEE, EXPRESSLY OR BY IMPLICATION, THAT THE SERVICE OR ITS CONTENTS WILL MEET YOUR REQUIREMENTS AND EXPECTATIONS OR THAT THE SERVICE WILL BE AVAILABLE WITHOUT INTERRUPTION, OR BE FAST, SECURE OR ERROR-FREE.
You are solely responsible for your Internet connection. Jnovate is not at any time responsible for you not being able to download or otherwise access the Service or its contents.
Limitation of liability
Jnovate IS NOT LIABLE FOR INDIRECT LOSSES, SUCH AS LOST PROFITS, GOODWILL, LOSS DUE TO DOWNTIME, LOSS OF DATA AND SIMILAR COSTS OR LOSSES, OR EXTRAORDINARY, EXEMPLARY, PUNITIVE, SPECIAL, INCIDENTAL, OR OTHER CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, IN THE ABSENCE OF INTENT OR GROSS NEGLIGENCE BY Jnovate. Jnovate SHALL NOT BE LIABLE TO YOU FOR ANY DAMAGES RESULTING FROM YOUR DISPLAYING, COPYING, OR DOWNLOADING FROM THIS Add-on. Jnovate'S TOTAL LIABILITY FOR CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE SUBSCRIPTION FEE YOU PAY TO US IN RELATION TO THE PART OF THE SERVICE WHICH HAS GIVEN RISE TO THE CLAIM OVER THE LAST 24 MONTHS.
Changes to the Agreement
Because of changes in technology and the growth and development of our business, or for other business reasons, we may need to modify this Agreement from time to time. You hereby agree to regularly review this Agreement to ensure that you are informed of any changes.
By your continued use of the Service after the changes have entered into force, you are expressing and acknowledging your acceptance of the changes.
Governing law and disputes
Unless otherwise required by a mandatory law of a member state of the European Union or any other jurisdiction, this Agreement is subject to the laws of Sweden, without regard to choice or conflicts of law principles. Furthermore, you and Jnovate agree to the exclusive jurisdiction of the courts of Sweden to resolve any dispute, claim or controversy that arises in connection with this Agreement. If any of the terms of this Agreement is found to be inconsistent with applicable law, then such term shall be interpreted to reflect the intentions of the parties, and no other terms will be modified. Jnovate's failure to enforce any of the terms of Agreement is not a waiver of such term. This Agreement is the entire agreement between you and Jnovate and supersedes all prior or contemporaneous negotiations, discussions or agreements between you and Jnovate related to the Add-on, Service and Applications. The proprietary rights, disclaimer of warranties, representations made by you, indemnities, limitations of liability and general provisions shall survive any termination of this Agreement.
